SERVICE CONTRACT
SCOTT COMPUTER REPAIRS LLC, SERVICE CONTRACT
This Computer Service Contract (the “Contract”) is entered into____________________ (the “Effective Date”), by and between Scott Computer Repairs LLC (“SCR”) and ______________________________________________ with an address of _______________________________, (the “Client”), (collectively the “Parties.”),
SCR agrees to provide computer repair services for Client subject to the following terms and conditions:
1. REPAIR SERVICES PROVIDED. Beginning on __________________, SCR will provide to Client, computer repair service(s) as listed at www.scottcomputerrepairs.com under PHILOSOPHY and SERVICE (collectively, the "Services").
2. PAYMENT. In consideration of the services to be performed by SCR, the Client agrees to compensate SCR for the services rendered as follows:
a. SCR labor charge – to be determined on a case by case basis.
b. SCR diagnostic charge - to be determined on a case by case basis.
c. If parts are needed, payment for parts must be paid prior to commencement of work.
If any invoice is not paid when due, interest will be added to all overdue amounts at $5 per day. Client shall pay all costs of collection, including without limitation, reasonable attorney fees.
In addition to any other right or remedy provided by law, if Client fails to pay for the Services when due, Client has the option to treat such failure to pay as a material breach of this Contract.
3. COSTS AND EXPENSES. In addition to the fees specified above, Client will reimburse SCR for any incidental costs and expenses SCR incurs in performing services for Client under this Contract.
4. TERM. This Contract will terminate automatically 7 days after Client received service.
5. PERFORMANCE OF WORK. SCR shall repair or replace modules, subassemblies and components of the Computer System, as required by the Client or deemed necessary by SCR. If SCR elects to replace any module, subassembly, or component, SCR is not responsible for securing the parts removed and thereafter, client cannot request such parts after computer is collected.
SCR shall be released from all obligations hereunder, if the Client, anyone or company, makes alterations or modifications to the Computer System, attaches devices to it not supplied by its original supplier, or performs or attempts to perform repair services on it or any portion thereof during the term hereof. Client shall provide SCR with access to the Computer System and with sufficient work-space required to perform Repair Service.
6. PRECAUTIONS.
a. At all times throughout the period of this contract, SCR is not responsible for loss or damage caused by fire, theft, testing, or other causes beyond our control.
b. SCR will dispose of all jobs left uncollected after 30 days of completion in whatever way necessary, not limited to sell, salvage, recycle etc.
c. SCR is not responsible for data loss on any media to include hard drives, DVD, CD, or USB drives. It is the responsibility of the Client to backup up documents, pictures, videos and soft wares prior to dropping off your devices.
d. The Client is responsible to check all jobs before leaving. SCR is not responsible for damages that happen after leaving service location.
e. SCR is not responsible for bodily injures, slip and fall, motor vehicle damage, virus contraction: includes COVID-19, while at the service address.
7. INDEMNIFICATION. Client agrees to indemnify and hold SCR harmless from all claims, losses, expenses, fees including attorney fees, costs, and judgments that may be asserted against SCR that result from the acts or omissions of SCR and/or SCR employees, agents, or representatives.
8. WARRANTY. We currently offer a 7 days free repair if the same problem which was repaired re- occurred (with the exception of virus. misuse of computer or equipment, water damage, physical damage, etc). We also provide a loaner laptop at a minimal cost (subject to availability) for the duration of time your computer is in the shop. Computers are repaired on a First In First Out basis and we take no more than we can manage to repair within a 48 hours period.
9. CONTRACT. This contract is not conclusive hence, SCR can alter or modify this contract without prior notice. It will be assumed that Client has read and agreed to this contract prior to engaging SCR for services, hence the validity of this contract stands whether signed or unsigned. Premises is secured by security cameras and can be used to authenticate drop offs and pick ups.
